Dole, a well-known brand in the fruit industry, has recently settled a class action lawsuit worth $4.3 million. The lawsuit was centered around allegations that Dole's fruit bowl products were misleadingly advertised as being contained "in 100% juice" or "in 100% fruit juice," when they contained trace amounts of other ingredients. This settlement has opened up the opportunity for consumers to claim compensation, with or without proof of purchase.
The class action lawsuit accused Dole of falsely advertising their fruit bowl products. The products were claimed to be contained "in 100% juice" or only "in 100% fruit juice," but they were found to contain trace amounts of ascorbic acid and/or citric acid, or other ingredients. Dole, however, denied these allegations, maintaining that their products were appropriately marketed and labeled.
Consumers who purchased specific Dole fruit bowl products between January 12, 2017, and June 27, 2023, in the United States for personal use may qualify for a payment between $9.00 and $18.00 per household. The products include a variety of Dole's fruit offerings such as Doleâ„¢ Cherry Mixed Fruit, Doleâ„¢ Diced Apples, Doleâ„¢ Pineapple Tidbits, and more.
Estimated Payout: $9 Without Proof, $18 With Proof of Purchase
The total settlement amount is over $4,300,000. Without proof of purchase, claimants can file for up to 60 covered products at $0.15 per product. With proof of purchase, the payout extends to up to 120 covered fruit bowl products at the same rate.
How to File a Claim
To be eligible for a payment, claimants must complete a class action Claim Form by September 25, 2023, electronically. The deadline for submitting this Claim Form is November 15, 2023, at 11:59 PM Pacific Time. Claims can be submitted at FruitMarketingSettlement.com
